MEXICAN WILL MODIFICATION

Probably one for Intercasa. Can a Mexican will be modified by the owner, without returning to Mexico? How does one do it?

You cannot modify a will, you just do a new one which revokes the old one.

Mexicans can make a will at their consulate outside Mexico but the Jalisco State Civil code specifically mentions Mexicans making wills and that would seem to exclude foreigners.

There is another clause saying that a will is valid here if it was valid in the place outside Mexico where it was made.

CAPÍTULO VIII
El testamento hecho en país extranjero
Artículo 2906.- Tendrán plena validez los testamentos otorgados por mexicanos en el extranjero,
siempre y cuando hubieren sido autorizados en las misiones diplomáticas; legaciones y consulados
mexicanos y se hubieren otorgado conforme a derecho.
Artículo 2907.- Para que en el Estado se admitan y tengan validez los testamentos hechos en país
extranjero, se requiere acreditar que hayan sido otorgados conforme a las leyes del país en que
pasaron.

However, if you have Mexican assets like property or bank accounts you do need a Mexican will, correct?

A beneficiary clause on a bank account can avoid probate and a beneficiary clause on your property deed to your spouse or parents or kids can also avoid probate. A will is good to have in case something changes or someone dies and then you die before you can change beneficiaries.

Can a new will be written ......Mexican... outside of Mexico, be properly recorded, and accepted by Mexico?  How does one do it? In this case, want to add a beneficiary!
