I have rented an apartment here for one year. My lease was up last month, and I renewed for one additional year. I gave a really big damage deposite to the landlord last year. (in addition to 2 months rent). He said rather than returning to me, and me giving it back, he will just keep it. In the USA we have a legal right to claim the interest on that deposit when refunded. does the landlord owe me the interest for 12 months on a $1000 usd damage deposit? The new lease is exactly like the former lease. What is the legal custom here?

NO!!!
Unless your lease specifically states such an arrangement.
Then, technically, you should have permission for activo lucrativo, to earn money in Mexico.

No it is not on the lease. In the USA they gave me 6 years accumulating interest when they returned the deposit. Guess they do not do that here. Curious, i earn money in my Mexican bank with interest. Isnt that the same?

Passive investment with a recognized financial institution does require the same "permiso" as an individual making deposits/loans with another individual for a lucrative return.
But we're talking small potatoes here and not reality. What would the interest be on a $1,000. US for a year at what?...1% interest?...$20 US dollars?

good luck with the interst on the deposit and be glad if you get the deposit back to start with, many people do not.

This. No one I personally know has had a deposit returned. That doesn't mean it won't happen but it is rare.

I have always had my rental deposits returned. There was no interest added in any case.

It is more then 1% interest. If i owe my landlord even $10 usd he asks me. Why should'nt i ask him for the same? I will ask the other tenents if they got theirs back. Some of them rent other houses from the same landlord, but they come part time. Will get back to you if its good news.
