Seperation
The time has come that we have to part ways with our housekeeper of three years, and it is mostly our choice.
We are not sure of the fair and legal separation pay.
We Know it should include xmas and vacation pay. it is the actual separation pay that we cannot determine.
Thanks in advance for the help.

Re: Seperation
Rollybrook.com, round up, and get a signed receipt. Tell her you can't afford it anymore. One wishes to discourage an appeal, which could be expensive. Make her happy and she will not come after you IMHO.

Re: Seperation
Better yet, go see a lawyer such as Spencer in Chapala. He will make up the proper documentation for her to sign and ensure you have paid the correct amount.

I second what CBob said. Worth the small charge to have it done correctly.

Re: Seperation
I agree with JayBear, no need for an attorney, but I am not sure Rolly Brook's site is still active. Here is an alternative:

Re: Seperation
I would recommend taking the case to Spencer... Laws change and while Rolly Brooks did an outstanding job of cataloging, his information could be dated...

Re: Seperation
Agree with Groovy and JB, no need for an attorney, it's so simple. Make her happy, have her sign that she's happy, pay her off, give her a gift or something, tell her you can no longer afford to have a maid and you will have to clean yourself. No problem, as long as she signed.
Edited to say: If the separation is ugly, you don't have a good relationship, if she doesn't like you for some reason, if she is angry, if you can't find another job referral for her, then by all means get a lawyer involved.

Re: Seperation
We went to Acuzana and had her draw up the papers. It cost us over $7,000 pesos in payments to sever two part time employees, a gardner and a maid. We had to sever them because we sold the house and even though we took them to the new house we still had to sever them. The gardner came 3 days a week and the maid 1 day a week for about a year. I would not try to sever an employee without getting the right paperwork to do it cleanly. Employees in Mexico have a strong Labor Union and you can get into a lot of hot water if a severed employee decides to challenge the severance with the union.

Re: Seperation
I have neither a regular maid or gardener. I have a small house and so I can usually keep the place up myself.
We have the name of a woman who does maid work and may call her occasionally, but not on a regular basis.
My biggest problem is trying to find a worker that will give me a few hours now-and-then for $75 or even $100 per hour. Nada.
