I had an accident on Monday 14th of Nov.

I am being told that we have to have a judgement from the Ministerio publico declaring a responsable party to be able to get the car out.

As of yesterday Nov 24th we did not have that judgment .

I am supposed to present myself in front of the MP when called to hear  about their decision. I hear there is a decision  as of yesterday Nov 24th but I cannot reach anyone to hear when I will be called in..

Meanwhile after the decision is announced to all parties we have to get an order for the release of the car. Then another process starts. I have to present tarjeta de circulacion, registration and ORIGINAL factura for verification of ownership where someone has to check the vin number from the factura to the vin number of the car. I am told this may take 20 days. We will see.

The insurrance does not pay for the daily fees or the hauling to the yard.. and they are raking in in the money every day.  I cannot get the car out until they decide I can get it out..Not sure who the THEY is yet

I want to pay and get the car out but right now no deal.. I have to have the judgement and  have someone say it is my car...and then it   will take more time..

I know this is going to be another learning experience showing how screwed up the system is.. No wonder people hit and run or pay off people...

More later after I reach my lawyer who today is not available..

Is this a state fiasco or federal? I'm having a hard time thinking that your average working joe in Guadalajara would be without their vehicle for months after a "non fault" fender bender. Imagine how big the impound yard must be considering the number of accidents per day.

They must have mighty large corals somewhere... That is why they have so many hit and run accidents and why people work it out. If you have people hurt and you cannot work it out for whatever reason, you go in front of the MP and your car is inpounded and the fun begins.. That is also why people work it out when no one is hurt..
The last thing you want is the MP involved because then then you are like a fly in a cobweb

Seems to me that you might need a Mexican representative with CLOUT! (Not sure how this translates to Spanish.) Altho I do not think Spencer McMullen in Chapala handles this type of thing, perhaps he could recommend someone. In my view, you need someone who is "connected" in court circles.

So sorry for your continued difficulties!

I guess, before I banged my head against the process, I would at least find out if the "legal assistance" povided with the policy also includes help extricating the car from the coral. Falls under that category in my mind. Worth a phone call anyway. Even if they don't offer real human on-site assistance, they might at least give you advice on the best approach to take.

I know I have coverage with same company that you do, and use the same agent. So I'll definitely be following it. Good luck!!!

I have legal aid and a lawyer who will file the paperwork to get the car out. I Have people working on it and it will take a minimum of 20 days after we get the dictamen from the MP.
Right now the delay is from the MP The accident was almost 2 weeks ago and we still do not have a decision on who is responsable for the accident . They could not decide on the first go around..
Without the dictamen there is no order to release the car and once you get the order to release the car from the state ythey have to check if you are the legal owner and that takes a minimum of 20 days so so far if everything goes well I can look for another month assuming they can decide on who the responsable is meanwhile the 3 cars are in the yard and cannot be taken out.

From what the lawyer told me the dictamen was supposed to be in onThyrsday but now the MP has to decide on a date and obviously we are not the only people around...

We were doing business with Jesus father when we first got here and we are some of the first clientes of Jesus, we are good friends with him so the agent is not the problem , the lawyer is the typical lawyer from a large insurrance compamy for that type of problems. Right now the MP is the one that is delaying the process ...but ifit wer not the MP there would be something else are accident cases are obviously not a priority.
This is just what you can expect if you find yourself in that case.
No the insurrance does not cover the dauly fee or the hayling.
Forgot toask about the rental but I would bet it is not covered either..

The lawyers working on those cases are nothing but paper pushers, they are at the bottom of the totemple., this is what I am being told by several people who have gone through it.
I guess in this case the State is dragging its feet or is going at its usual spped...if they went slower they would go backwards..
There are 3 people in that accident so I am not the only one involved ..I was warned by Mexicn friends that this was the part part of the Mexican system so I am not surprised ..it is the way it goes ..
Right now I hope the MP will give us a day to appear .

I would ask what is the monetary value of your car?

I know as a fact you can move things faster with the MP if you let someone there know you will be very appreciative.

Handle it the Mx. way, with courtesy and a good handshake.

Thank you but all parties involved are Mexicans so they do not need advice on the Mexican way. Very Happy

Just want to see how the process goes, the car is worth very little and when I am ready to leave again I may just sell it for a dollar to a friend who needs a car and walk out so I am not worry just curious to see how things will turn out.
