After reading comments in another thread that referenced my website, I realized that my website was not very clear on this subject, so I have revised it thusly:

The termination pay shall include 3-months salary plus 20 days for each year worked plus prorated vacation and Christmas pay.

20 days means 20 times the daily rate which is 1/7 of the weekly rate.

Example: A maid worked 2 days per week for $50 pesos per day for 4 years That is $100 per week. There are 4.3 weeks in a month, so she is being paid 4.3 x 100 = $430 per month. Her daily rate is not $50. It is 100/7 = $14.29. So her termination pay will be (3 x 430) + (20 x 14.29 x 4) = 1890 + 1143.20 = $2433.20 plus any Christmas and vacation pay that may be due.

It id perfectly clear to me Rolly, Most don't realize they will pay....approx., 20% of salary per year severance

I think it may be $5000 pesos, not dollars. In Rolly's example above, a two day a week person, for 4 years, gets $2433 pesos so double that puts it around $5000 pesos not USD. Shit, for 5K USD every employee in town will be looking to get terminated..........

How about everyone start using USD, CDN, or MXN when quoting amounts to eliminate confusion? Either that or start assuming that evrything is stated in MXN.

Unless stated otherwise I always assume every discussion on here is in pesos. It is after all the currency that we pay for things here other than some real estate.

Some people haven't been here long enough to realize that Mexico uses pesos, not USD or CDN or they have their head you know where.

Thanks Ferret, redid the math...using Rolly formula...paying my gardner 550 per week divided by 7 ...78.51 times 20 = 1571.43 times 7 years =10,999.99 plus 13 weeks pay 7520 = 18519.99.

Question for Rolly? If I terminate in week 51, am I required to pay the 3 months plus 20 days severance? Approx. 9000 pesos?

Jim, the three months severance pay is actually 90 days...90 x78.57 = 7071.30 pesos.

I believe the major problem most of us have concerning severance it that we just can’t believe it’s such a pittance. Now I realize for those living on a fixed income and have been here for some time this is not the same reality and after so many years it will probably be the same for us. But we just learning the ropes can’t wrap our minds around this; we think we must be wrong, so we interpret the wording so it makes a little more sense to us. Setting aside a $100.00 USD per month, per employee didn’t seem unreasonable so I never questioned it, simple as that, but the longer you’re here it seems it just doesn’t make sense.

It was like when we first arrived, figuring TIPS, the right amount was so small I felt I was wrong. Over time it seems we all adjust though, with more understanding.

Once again, Thanks Ferret & Rolly for your unending support with these issues. And yes when and if it ever gets serious I’ll go to the professionals, it’s just nice to believe we’re trying to do the right thing.

You're absolutely right Parker, it IS a pittance and that's why it makes me so frustrated when people fail to do the right thing. You, Jim and others are to be commended for taking the Federal Labour Laws seriously.
To us, it's a pittance, to Mexicans it can be a life changer.
