We have had our housekeeper for 10 years. She is bar none the best in this area. We treat her well, she treats us well. It's a mutual respect thing. Our new gardener has been here over a year. He too is a great guy. We're hoping he'll be with us for the next 10 years or longer.

We pay them when they're sick. they get a months bonus at Christmas. Plus gifts. So, everybody is happy. I do not like discord in my house, and I don't get it because everyone knows what is expected.

We treat our help the same. If you can afford it why not. It is the decent thing to do in my opinion.

I would love to hear the rest of this story if a Labor Defense Department Prosecutor gets involved. This guy will be screwed and receive a Labor Department enema.

Well “Cheap is Cheap” has just risen to a new level. This must really be a desperate employee, sad.

Looks like he's back to his old self as SOLOVINO.

JimW, don't make excuses for him. He's always liked insulting people and he thinks it actually bothers us, NOT.

Back to the original thread of Employee Compensation. The law requires that you pay Christmas Bonus and Vacation BEFORE December 20.

We like to give our maid and workers their Christmas Bonus and Vacation at least a week or more ahead, so they can use it for Christmas ahead of time.

You're a TOTAL JERK. I guess I should take some money away from our maid who we've had for only TWO years because we paid her for TWO weeks vacation.

As far as your formula is concerned, hardly anyone at Lakeside follows it. It is not the law. Even Severance Pay is not the Law and YOU are NOT a lawyer.

You really are an idiot John. It IS THE LAW, FEDERAL LAW and there is a formula for the calculation of the Aguinaldo, the Vacation Pay and Severance Pay. The LAW should be followed and kept completely seperate from any other money that you bestow on your help.
I suggest that YOU go to a LAWYER and find out for yourself.

ferret - I know the formula. We pay our maid well. We will only need a lawyer for Severance when we sell the house. And even then, the formula does not have to be followed, if you make a reasonable Severance pay to them and they sign off on it.

You can try that...but it is highly unlikely that any fudging of the LAW takes place in a Real Estate transaction where the information is documented carefully. If I was a buyer, I wouldn't hand over a penny until I saw that documentation. Penny wise, pound foolish. Your hide and your reputation.

I may be a total jerk but I'm not ignorant, bigotted, or rude like you are. The Labor Law is very specific and you're on record for having said you're not going to follow any "stupid formulas."

I’ve guess I’ve reached by breaking point; John, I really could care less how you treat many on this board because they certainly have not treated you any better but when it comes to any relationship with the people we employee and their due right, is where I and many others draw the line. I’m afraid you maybe one of the “Cheapos” (sic)

From your posting it sounds like you didn’t plan well for your retirement and the lifestyle you think you deserve. Many of us live a much less grander lifestyle so we can share what privileges we have with others.

Shit, sell your house and rent a casita and see how far your money would go? We really have very few “Jones” here so the “best of the best” is not all that necessary for a good lifestyle, honest.

Ok here is my Xmas bonus for my maid calculated using Rolly formula.

52/365 times 15 times 150(works 3 hours a week at 50P per hour)
xxxxxxxxxxxx xxxxxxxxx (money per week)

315Pesos is answer

I would pay her 500 pesos so I never caluculate the formula out because
I knew I gave her more. I also give her monday off with pay as xmas is
close to her workday with me on Monday. So maybe John gives more than
required like I do and all this talk is meaningless. Yes John does not know how
to express himself sometimes but don't we all at one time or another.

He expresses himself quite will when he claims that Vacation, Aquinaldo, and Severance are NOT the law. Seems very clear to me.

Well, they are the law, and realtors make sure that you pay them. We, at one time had a second house here. When we sold it the Realtor gave us the papers with severance etc. all worked out. Our gardener didn't want to accept the money, so I had to force him to take it and drag him across the street to another house for witnesses to sign that he had received the FULL amount owing.

Realtors here WILL not close on a house which has not given full compensation to the employees. PERIOD!

Yea true David but how many of us who have maids pay the Mandatory government insurance?
Yes Housekeepers are exempt but you are suppose
to get it in writing that she doesn't want you to pay for insurance. I bet
the vast majority of us are in violation of this including me LOL. Just saw this
in Rolly's website getting a formula.

Our housekeepers are independent contractors unless employed full time, as are gardeners. Ours owns a rosticeria. That's my reading of it. Our gardener does pay his own IMSS.

52/365 = .142. where does 15 times come in?

My maid works 3.5 hours x 40 pesos = 140 pesos. How much should I give her?
