Suspended notary issues private property deeds on federal property in Ajijic
As has happened with many other invasions of the federal areas surrounding Lake Chapala, in the community of San Antonio Tlayacapan in the Ajijic area, the inhabitants of this place denounce fraud and corruption of the notary public number 126 of Guadalajara, Alvaro Guzmán Merino, who was suspended from his duties for 12 months from August 2020 and issued deeds for a federal property in February 2021 when his suspension was still in effect

Thanks Plan B. Never hurts to be reminded that the world is not round and it's not flat, it's crooked. Buyer beware!

There is an active pro-lake movement that is removing illegally fenced-off federal property at shoreline. Good story in English at link below. The local MXN papers are doing a good job covering this.

I was told when that new house was being built at bottom of Donato Guerra in Ajijic, that it was owned by a GDL notario. Hmmmm.

MC---  The Earth Day programs and booths will likely have info on what's been going on.  There are also these FB groups. Julio Carmona is the lawyer who has filed suits against some of the illegal activities; he is scheduled for a Sunday presentation.

You may want to have the Mexican nationality before enforcing Mexican laws . I don t know, but I would not mess with the fences unless I were a Mexican citizen.

The prosecutor's office won't proceed with a criminal complaint against those illegally building a floating dock on the lake west of Ajijic. They said they couldn't charge anyone with a crime because there was no activity when they went to the scene....despite videos and pictures presented by the environmental group including sworn statements by a Notario.

FGE decides not to exercise criminal action for sand extraction in Alseseca
By Gilberto Padilla Garcia
The Prosecutor General of the Republic (FGE) determined not to exercise criminal action within a complaint filed by a group of residents of #Ajijic against the extraction of sand from Lake Chapala that carried out volteo (bulldozers) machines and trucks in the month of May 2021 in Alseseca, for the construction – allegedly illegal – of a floating dock in the federal area.
Despite the photographs, videos and even a faith of Notary Public that presented the disagreements in their complaint filed in July 2021, the FGR gave the lines of investigation to exhaust, not finding evidence of extraction and any other action that damages the body of water named #Chapala Lake, according to the resolution.
The FGR supports its determination in a criminal investigation report issued by the Federal Ministerial Police based in Ocotlan, dated 27 July 2021, in which it concludes that at the place of the reported events, at the time of implementation Ar the inspection, "... no excavations, machinery or volteo trucks are observed."
Another report in the specialty of environmental crimes issued in September 2021 indicates that it is not possible to issue a technical opinion, because at the time of inspection "... the extraction of petroleum material in national waters corresponding to Lake Chapala is not visible, because the water level covers the study area
According to a circumstance of verification act raised in the month of October 2021, the Directorate of Legal Affairs of the Body of the Lerma-Santiago-Pacifico Cuenca of the National Water Commission (CONAGUA) states that the forecast located in the n number 54 of Alseseca Street, where the works were carried out reported, not within the federal zone.
In addition, the Directorate of Legal Affairs adds that at the time of the inspection there were no people doing works related to extraction material on the shore of Lake Chapala, in addition to that "no zone occupation is disqualified federal, so crimes are not checked reported and the FGR lost the lines of investigation.
One of the members of the group of citizens who denounced the works that were carried out on the beach of Alseseca on May 20, 2021 on the beach of Alseseca, regretted the determination of the FGR, despite the evidence presented to him s, mostly photographs and videos where Volteo machines and trucks are appreciated working in the area.
While there were no people, no machines or trucks working on the site when the tasks were carried out, there was an intention to build in the federal area by the dealership, “... but they ignored the evidence we presented, besides that they did not proceed at the moment, but later when they saw that we opposed what they were doing.”
Despite the determination of the FGR and the little interest of the #CONAGUA in investigating the reports of invasion in federal areas in the municipality of #Chapala, the group of uncompliant citizens of Ajijic will not give up and will continue their fight,
"... because all the tests were made to come, but we already saw that they do not obey the interests of the citizens."

I am a naturalized citizen and I would do that, if the authorities are not going after these people , obviously some have connection and it is not a good idea in Mexico to go against pople who have power when you do not..JUst a gut feeling..

Doing the right thing and fighting for the right cause does not mean that the law prevails. In Mexico, it's WHO you know.
The couple, who owned the hillside at the north end of the San Pancho beach, diverted an arroyo whose natural path crossed their property at the bottom annually. That diversion caused the water to flow down the road and damage other people's property.
We had the town on our side and we had photographic proof. There was also a BRIDGE on their property that spanned the annual occurrence.
Those people had very powerful friends in the Mexican government and we gave up, sold and moved.

I doubt they are a non profit, it is a complicate and lengthy process ...THe problem is that the laws are there, it is public land, cannot be fenced or taken over... but the enforcement falls under the municipality and that is where greet or corruption gets in from all sides. A Mexican neighbor denounced several time another Mexican neighbor when he was building a wall and filling the land , invading the federal zone. The authorities came a few time and work was stopped over the week-end the invader told his people do not worry work starts again on Monday and it sure did , After that he put another fece in front of the property that was invated, to grab some more.. Chapala is not enforcing nothing.. and that is what happens.
This kind of thing is happening all over Mexico and unless the property that are being invaded belong to people with money and power, nothing happens... We see that in Chiapas all the time where private land and reserves are being invated taken over and destroyed and nothing happens.

MOVEMENT 'ANTI-REJAS' WILL CLEAR BEACHES OF THE FENCES RELOCATED

IT BEGAN WITH THE REMOVAL OF THE CYCLONIC MESH LOCATED NEAR THE SIMAPA BOOSTER SUMP.

Cyclonic mesh being removed for the second time, which was found near the booster sump.

Sofía Medeles.- The Pueblos Unidos de la Ribera group removed for the second time a cyclonic mesh that had been relocated in the federal territory of Lake Chapala.

The meeting was held last Friday, April 8, at the invasion near the pumping station of the Municipal Drinking Water and Sewage System (SIMAPA), to the east of the town.

In addition to removing the mesh, the bases where the tubes are placed were also cut and covered, to prevent it from being placed again.

On this occasion, not only was the mesh removed, but it was broken up, and with a hammer, they closed the bases where the posts are placed, so that the fence would not stand up again, as happened the last time. Although they tried to intimidate them by taking video, the attendees did not give in to this action.

At the end of the meeting, there was talk of returning to the beach in the area known as “Tío Domingo”, where in the period from August to September of last 2021, at least seven fences were removed. Of all these, only two have kept the spaces free from the invasion, the rest, in addition to putting the fence back on two occasions, planted to justify their invasion, one of them with agave.

Also, recently two more were withdrawn to the east of Ajijic, after Donato Guerra Street; in one of these, the owners chose to remove the entire mesh and, in the other, they raised it again, however, it was removed again.

The meetings of the group to act against this type of invasion will be announced through social networks. Members of the “anti-rejas” movement considered that the participation of the ajijitecos and interested parties is important, since it is a topic of interest for all the inhabitants around the lake.

Example of false deeds having been issued. Translation from Google.

THEY DENOUNCE ATTEMPTED DISPOSSESSION INVOLVING FORMER CHAPALA OFFICIALS

WITH ALLEGEDLY FALSE DEEDS, THREE SUBJECTS CLAIMED POSSESSION OF A PROPERTY CLAIMED BY A FAMILY FROM AJIJIC

April 19, 2022EditorAjijic

Sofía Medeles.- Owners of a property in Ajijic, denounced on April 12 an attempted dispossession with false documents and advice from former Chapala officials related to other invasions in the area.

The presumed invaders pointed out by those affected are the lawyer Omar Pérez Contreras, who in previous years would have served as head of some secretariat of the Public Registry of Property, in addition to being a defender of the case of federal invasion that occurred in San Antonio Tlayacapan, by the former local deputy candidate Jesús Arambul Solorio; Tonatiuh Cañedo, former director of Regulations, Inspection and Surveillance of Chapala and Sergio Antonio Macías Aldana, notary of Tuxcueca who was suspended in January 2020 for 18 months; Although the reason is not known, it is speculated that it was due to bad practices.

The Ibon family was the one who claimed possession of the land because they have the deeds from the year 1950 of the property called "Los Tepetates", which is located in La Floresta, next to the Riviera Alta subdivision, which they have preserved by inheritance. .

Members of the family consulted commented that they found out about this invasion thanks to the fact that their neighboring neighbors, with whom they have a long-standing friendship, told them that they had entered their property with a machine last Tuesday, April 12.

Upon arrival, they met the alleged owner, Omar Pérez, Tonatiuh Cañedo and the notary, who received them, according to verbal attacks. Upon arrival, the municipal police verified both deeds, confirming that the alleged owners were wrong and agreeing with the Ajijic family.

“In the deeds they presented there were several inconsistencies. One of them is that they were looking for the land 'Los Ahuilotes', when ours is called 'Los Tepetates'. Another of them is the year of acquisition, their deeds are from 2009 when ours has more than two generations in the family, in addition we do not know the supposed owners, nor who they say sold them, "said one of the co-owners .

In addition, the family asserted that they learned that those named were searching at all costs for information about the property and the owner family, even going so far as to offer money and land in exchange for information being provided.

After a heated discussion and the intervention of the police elements, the presumed invaders gave in and took out their machine, alleging that they would look for the land they owned.

"We do not believe it was an error, but rather an attempt to dispossess them due to the way they were handled, a way for which there is already a history in both Ajijic and San Antonio, in addition to the background of those involved who presented themselves," one of the complainants stated.

Finally, members of the Ibon family warned owners close to their property and landowners in general, to be on the lookout since these types of events have been recorded in recent times. On the other hand, they were grateful for the support they received from residents of Ajijic and from friends who alerted them, and provided them with the necessary information for their investigations.

Likewise, they asked the authorities to be aware of these practices and methods of invasion, and not allow this type of abuse, since there have been several cases that have been documented in Chapala, related to the dispossession of land.
