Small Claims/People's Court? Empty Small Claims/People's Court?

Post by Talosian Wed Apr 24, 2013 6:37 am

As a preface"

I am a great believer that knowledge of all sorts is good, even if one may not now or ever have a need for it.Sometimes I ask questions simply to have the knowledge. Just FYI.

As I recall from several years ago, there is some kind of Small Claims Court (People's Court) that is local to the cities.

Does anyone know about this?

This is I believe different from the mediation program the Municipality has and different from Profeco.

My experience with the local mediation program was relating to a disagreement with my (former) Fracc and disclosure of information required by law. I actually thought at first it was a court but later found it was strictly mediation and for me, of no use.

Thanks to those who will/may respond directly to my question.

There is only conciliation where the parties are required to show up but the court does not have jurisdiction to force one side or bind them into making an agreement. The municipal judge will hear arguments and admonish a arty who is ion thew wrong that they have no legal foundation for their position and that the other party would prevail n a civil suit filed in state court but that is as far as it goes.

No freebies in Mexico, gotta pay for attorneys, and experts (translators) where foreigners are involved.

Can I subpoena a witness or will the (I'll call it arbitration) hearing officer accept a written declaration?

Thanks.

I don´t recall there being any real procedure, the moving party appears and the police notify the opposing party of their need to appear, it isn´t that formal.
