yes every year we see articles about it and nothing is ever done. Right at the end of our street two people have taken oven the Federal Zone , complaints have been made by numerous Mexicans and they were told that the Federal zone has to be defended by the Municipality. They show up one day tell people to stop whatever they are doing and then totally close their eyes when 2 days later the work resume.
If you walk the lake you are prevented from continuing by new barriers every time the lakes goes down and the offenders are the people who already have large properties.
Let´s face it the Municipality has no interest in enforcing the law so the Informador writes an article every year about it and nothing happens.
This has been going on for years and there is no change, actually it is getting worst and worst.

unfortunately the municipality has no authority in these federal matters whatsoever. the muni is being told by the feds to get rid of part of the san antonio malecon,for example,which was illegally built by the muni.

One really has to wonder what the agenda is when this agency is tearing down parts of a used and popular Malecon while at the same time allowing all these private incursions along the lake front.
This deal smells to high heaven. The people of San Antonio are well justified in their protests about it.

Not to hard to figure out....ability to pay legal fees, politics, and personal connections...just the way it is...es México.

Pedro you are incorrect. When my neighbor who is an educated, well to do Mexican went to complain about the encroachment of the Federal zone to a Federal agency he was told that the Municipality was in charge of the enforcement. Sure enough somebody from the municipality came to close down the work and then the work started again a day later, over the week -end and was back to normal on Monday.The foreman told his people do not worry come back tomorrow. In other word someone got something out of the deal .
My neighbor went to the newspaper as well and something was published back then as well..
My take on it is that someone told the enforcement people not to do anything.Another deal that smells.

One thing that seems to be consistent is that the local and state governments here are affordable.

About a week ago, there was another article stating that there was going to be a full mapping and survey done of the lake this year to document where the invasions have taken place and provide documentation against further invasions.

The surverys are only good if something is going to be done , if it is to slap these people with a fine and then let them keep the land they stole from the public it is just another farce.

The municipality controls construction performed on the federal zone just like the rest of the land within the municipality. Fees for the concession (lease) on federal land are collected by the municipality and remain in the municipal treasury.

Pedro, the municipality stopped the work for a day and chose not to come back when they were told the work had resumed so they do have the authority to stop work in the Federal zone.
You just do not know what you do not know and want to appear as the whole knowing guru, sorry you are wrong. This neighbor is shatp as a tack , he is well informedand he is very well aware of whose responsability it is to stop illegal work in the Federal Zone.

the muni can only work under the direction of the feds. when that golfer attempted an encroachment, it was the muni equipment that was used to demolish. it's quite simple,the feds don't have their own equipment everywhere that it's needed.

In this particular case there was nothing to demolish just stop them from building a retaining wall. The municipality did not even do that although they knew about the work, they stopped it once and did nothing when the work resumed although complaints were made again. Now it would be a huge job to change anything as the retaining walls were built and fill was brought in.
There are other families further down towards Lucerna who are building a fence to the lake every time it goes down. Nothing happens there either. You do not need an airplane to see the violations just walk the lake and it is pretty obvious.
The municipality is chosing to ignore the violations and then every year or so the Informador write about it. It is all a bad joke.

i could have sworn that informador wrote about conagua's administration over the lake or lack thereof. and they are not a department of chapala,are they!

The municipality issues building permits. They will only issue a permit for work on federal property if the required approval has been made on the federal level. Without a building permit, any work being done is illegal and the municipality can shut it down. You are misinformed and mistaken.

We have a property right up to the Federal tide line on Los Muertos Beach in Puerto Vallarta. Anything built over that line must be temporary in nature (Palapa for example). I have heard of many prolonged battles over mere centimeters. It takes many years to register a Federal Lease and many people exploit this. I know they take their jobs very seriously - this property belongs to the people of Mexico, and they feel they are safe gaurding it for the future.

When the Mayor of Cihuatlán, Jalisco, wanted to have a house built on federal beach access that the fishing
CO-OP used in Melaque...
the first thing the fishermen new was when..
the rebar arrived one morning in the space and the wire cages were being made... a partition went around town and the rebar was removed first thing the next morning... and that was that.

How many ways do you need to be told that SEMARNAT issues federal concessions on land along waterways. And that a building permit for the owner of the lease to build on that land is issued by obras publicas in the municipal government? Have you now or have you ever held a lease on land within the zona federal?

They are like Hacienda - you do not want mess with them. In the case of the Mayor -he will never be able to sell that house, it is worthless. In the case of tearing down the new Malecon, they must have built it so good they consider it permanent. So now it has to betorn down, and only then can they apply, or reapply, for proper concession which may or may not be granted. This not negotiable. This is their rule.
